司法府は、議会の制定した法令に異議を唱え、また解釈を要求する訴訟事例、被告人が連邦法違反を理由に告発された刑事訴訟の裁判に対し責任を負う。連邦裁判所はまた、憲法の規定をもとに問題とされた州法に係わる上訴管轄権、１州以上に及ぶる訴訟、１州以上の市民また国外の当事者に関連する訴訟の裁判権も有する。

  司法府は最高裁判所、下級連邦裁判所から成り、控訴裁判所（巡回裁判所または控訴裁判所としても知られている）、連邦地方裁判所、破産裁判所、連邦請求裁判所などが含まれる。連邦裁判所は、州裁判所から上訴された民事、刑事両方の訴訟を審理する。連邦裁判所の本来の裁判権は、特許、商標、連邦政府に対する申し立て、破産、金融保証、海事法、国際間の申し立てなどが対象となる。

  政府とは別の部門として、司法府は他の２つの部門から独立しており、憲法に規定されたチェックアンドバランスにのみ従う。独立した連邦司法制度は、すべての国民に公平と平等な正義を保証するうえで不可欠であるとみなされている。
