憲法は中央政府、州政府、地方政府の間で権力を分散して連邦の統治システムを構築している。

この３層構造による米国の統治システムの２つの特徴が基本となる。第一に、国民が中央政府、州政府、地方政府に仕える公務員を選出する。それぞれのレベルの権限は、国民に立脚する。第二に、各レベルの政府は、それが奉仕する地域の住民から徴税によって資金を調達する。各レベルの政府は、自身の財政基盤を確保できない限り、自立した活動は望めない。

政府の様々な構成単位の間で権力を分散するという概念は、政府の権力を規制し、その乱用を防ぐために考案された。建国の父達は、できる限り、政府のいかなる部門も他に取って代わることがないよう、憲法に“チェック・アンド・バランス”のシステムを組み込んだ。

国家レベルでは、連邦政府はさらに３つの自立した部門に分かたれている。

米国大統領府に象徴される行政府は法を執行する。

米国議会に象徴される立法府は法を制定する。

連邦最高裁判所に象徴される司法府は法律を解釈し、その法律が憲法に抵触しないかを判断する。
