歴史上早くから、米国人はヨーロッパの多くの国々に君臨し―そして分断していた―国教、または政府の庇護を受けた宗教という考え方を拒絶した。教会と国家の分離は米国憲法修正第１条に規定されており、それはひとつには、“議会は国教の樹立に関し、いかなる法律も制定してはならないし、そのための自由な活動も禁じてはならない・・・”と定めている。

  修正第１条は簡単に思えるが、時には米国憲法の学者にとってさえ、政治と宗教の間に明確な線を引くことは難しい。公立学校の生徒は、学校生活の一部として人前で祈りをささげてはならないが、米国議会の会期は通常、聖職者による祈祷で始まる。都市は公共の所有物にクリスマス像の展示はできないが、“我らは神を信じる”のスローガンは米国の通貨に表示され、宗教団体に寄贈されたお金は、課税対象となる個人の収入から控除できる。教会系列の大学に通う学生は、他の学生同様、連邦政府の貸付を受けられるが、彼らより年少の弟妹は、特に神学系の初等または中等学校に通うための連邦融資を受けることはできない。

  このように一見矛盾して見えるものを解決するのはまったく不可能かも知れない。実際のところ、それらの矛盾は修正第１条、それは議会に対し国教を樹立することもそれに干渉することも禁じている、に組み込まれた対立から生じている。これら２つの命令の間を明確に舵取りしていくことは米国の官僚に課せられた最もデリケートな課題のひとつである。
